The Freelance Isnt Free Act NYC

NYC freelancers, do you know about the Freelance Isn’t Free Act? This law was created to protect NYC’s 1.3 million freelancers and is the first of its kind in the country. It’s pretty new (passed in 2017) and I’m sure a lot of New Yorkers and most of the country don’t know it exists, so I wanted to share this info.

Under this law, freelancers are given protection against late or non-payment. It enforces 30-day payment terms, contracts (hiring party can’t refuse one), and retaliation from client for pursuing payment. Contractors can file a claim with the city and, if the hiring party is found in violation of any of these claims, the contractor would be able to collect damages for each violation.

For anyone who has ever had to hound someone that you completed work for who then refused to pay you, you know that is the most frustrating and devastating thing ever. Even if it is a small amount, that shit is the worst.

We all deserve to earn a living and not have to wonder if we’ll get paid. When you work for yourself, it becomes even more crucial that you’re protected and aware of your rights. For the most part, when starting a new project I always put all agreements in writing and collect a deposit before any work begins and that has served me well. But it is an extra relief knowing the city has my back.
